Terms of Use

These Terms of Use ("Terms") govern your access to and use of the TheGalleryPro website, web studio, and related online services (collectively, the "Site"), operated by Usman Zubair, trading as The Gallery Pro ("we", "us", "our"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract. If you use the Site on behalf of an organization, you represent that you are authorized to bind it.
2. Accounts
- You are responsible for the accuracy of the information you provide and for keeping your password secure.
- You are responsible for all activity that occurs under your account.
- Notify us promptly of any unauthorized use at our support contact.
3. Acceptable use
You agree not to:
- reverse engineer, decompile, or attempt to circumvent the software's licensing or access controls;
- share, resell, or sublicense your account or license keys except as expressly permitted;
- upload content you do not have the rights to, or content that is unlawful, infringing, or harmful;
- disrupt, overload, probe, or attempt to gain unauthorized access to the Site or its infrastructure;
- use the Site to build or train a competing product.
4. Your content
You retain all ownership of the images, albums, designs, and files you create or upload ("Your Content"). You grant us a limited licence to host, process, transmit, cache, and display Your Content solely to operate and provide the service to you (for example, generating and storing thumbnails and previews). We do not claim ownership of Your Content and do not use it to advertise or train models.
5. Our intellectual property
The Site, the software, branding, and all related materials are owned by us or our licensors and are protected by intellectual property laws. These Terms grant you no rights in them except as expressly stated.
6. Third-party services
We rely on third parties including Freemius (payments/Merchant of Record), Cloudflare (CDN and R2 object storage), and others. Your use of those services may be subject to their own terms.
7. Disclaimers & limitation of liability
The Site is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill. Our total aggregate liability is limited to the amount you paid us (via our Merchant of Record) in the 12 months preceding the claim. Keep your own backups of Your Content and project files.
8. Suspension & termination
We may suspend or terminate access for breach of these Terms, suspected fraud, or to comply with law. You may stop using the Site at any time.
9. Changes
We may update these Terms; material changes will be posted here with a new effective date. Continued use after changes means you accept them.
10. Governing law
These Terms are governed by the laws of Islamabad, without regard to conflict-of-law rules. (Note: purchase disputes are governed by the Freemius Terms of Sale and its arbitration clause.)
↑ TopEnd-User License Agreement (EULA)

This EULA is a contract between you and Usman Zubair, trading as The Gallery Pro ("we", "us") for the use of the TheGalleryPro desktop application and web studio (the "Software"). By installing, activating, or using the Software, you agree to this EULA.
1. Licence grant
Subject to your active subscription or licence and to this EULA, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software for your own professional or personal photography work.
2. Activation, devices, and licensing technology
- The Software uses a cryptographically signed, device-bound licence to verify your entitlement. Activation links your licence to the specific device(s) you sign in on.
- Your plan permits sign-in on up to 2 devices at a time. Signing in on a new device beyond that limit may deactivate an earlier device.
- The Software periodically verifies your subscription online. If verification fails, the Software allows an offline grace period of 7 days, after which paid features are disabled until you reconnect and re-verify.
- We record limited device information (such as a device name and identifier) for the purpose of enforcing these limits and protecting your account. See the Privacy Policy.
3. Subscriptions, tiers, and expiry
Access to paid features ("Studio" / paid tiers) requires an active subscription. If your subscription lapses, expires, or is cancelled, paid features are gated or disabled after any applicable grace period, though you may retain limited or read-only access as we determine. Billing, renewal, and trial terms are set out in the Terms of Sale and Refund Policy.
4. Restrictions
You may not:
- copy, distribute, sell, rent, lease, or sublicense the Software;
- reverse engineer, decompile, disassemble, or attempt to derive source code, except where this restriction is prohibited by law;
- circumvent, disable, or tamper with the licensing, activation, device-binding, or access-control mechanisms;
- remove or alter proprietary notices.
5. Your files and data ownership
You own your albums, layouts, exported designs, and source images. The Software stores some project data and assets locally on your device and may store thumbnails, cover images, and related assets in cloud storage to provide the service. You are responsible for maintaining your own backups.
6. Updates
We may provide updates, which may be required for continued operation or to maintain compatibility and security. Some updates may modify or remove features.
7. Ownership
The Software is licensed, not sold. We and our licensors retain all rights, title, and interest in the Software and all intellectual property therein.
8. Warranty disclaimer & liability
The Software is provided "as is" without warranty of any kind. To the maximum extent permitted by law, we disclaim all implied warranties and are not liable for indirect or consequential damages or for loss of data or files. Our aggregate liability is limited to the amount you paid for the Software in the 12 months preceding the claim.
9. Termination
This EULA terminates automatically if you breach it. On termination you must stop using and uninstall the Software. Sections that by their nature should survive (ownership, disclaimers, liability) survive termination.

This Privacy Policy explains what personal data Usman Zubair, trading as The Gallery Pro ("we", "us") collects when you use TheGalleryPro and this website, why, and your rights. We are the data controller for the data described here. Payment data is handled separately by our Merchant of Record, Freemius (see their Privacy Policy).
1. Data we collect
- Account data: name, email address, password (stored hashed), and account settings.
- Device & licensing data: device name, device identifier, app version, and activation/verification events — used to enforce device limits and secure your account.
- Content data: albums, layouts, and the images/thumbnails/covers you create or upload, which may be stored in cloud object storage to provide the service.
- Usage & technical data: IP address, browser/OS, and log data, including via cookies and analytics on the website.
- Support data: messages and information you send us for support.
Note: we do not store your card details. Payment information is collected and processed by Freemius and its payment processors.
2. Why we use it (legal bases)
- To provide, operate, and secure the Software and website — performance of a contract.
- To enforce licensing, device limits, and prevent fraud/abuse — legitimate interests.
- To send service and renewal notices — contract / legitimate interests.
- For analytics and product improvement — consent or legitimate interests, where required.
- To comply with legal obligations.
3. Sharing
We share data only with service providers who help us run the service, including:
- Freemius — payments, subscriptions, invoicing (Merchant of Record);
- Cloudflare — CDN and R2 cloud storage / image delivery;
- Hostinger — website & backend hosting;
- analytics providers, where used.
We do not sell your personal data.
4. International transfers
Our providers may process data outside your country, including outside the EEA. Where required, transfers rely on appropriate safeguards such as Standard Contractual Clauses.
5. Retention
We keep account and content data for as long as your account is active and as needed to provide the service, then delete or anonymize it within a reasonable period, unless we must keep it to meet legal obligations.
6. Your rights (including GDPR)
Depending on your location, you may have the right to access, correct, delete, port, restrict, or object to processing of your personal data, and to withdraw consent. EU/EEA and UK users may also lodge a complaint with their local data protection authority. To exercise any right, contact us at our support contact. The app also provides an in-account option to delete your account.
7. Cookies
The website uses cookies for essential functionality and, with consent where required, for analytics. You can control cookies in your browser settings.
8. Children
The service is not directed to children under 16, and we do not knowingly collect their data.
9. Changes
We may update this policy; material changes will be posted here with a new effective date.

Purchases are processed by our Merchant of Record, Freemius, and are also subject to the Freemius Terms of Sale. This policy summarizes how refunds work for TheGalleryPro.
1. Trials
We offer a 7-day free trial with no card required. If you do not subscribe, the trial simply ends and paid features are gated until you choose a plan. You are never charged automatically.
2. Refund window
You may request a refund within 7 days of a purchase where the Software has a material defect that our support team is unable to resolve. After acceptance of an order, payments are otherwise final and non-refundable, except as required by law or the Freemius Terms of Sale.
3. Renewals, upgrades, and proration
- Subscriptions renew automatically; you can cancel at any time to stop future renewals.
- Upgrades and plan changes are prorated against your current plan at the time of change.
- If you downgrade or cancel, any unused prepaid time may be returned to you as a prorated credit or refund, at our discretion and processed via Freemius.

All purchases of TheGalleryPro are sold by Freemius, Inc., which acts as the Merchant of Record and handles payment processing, taxes, invoicing, renewals, chargebacks, and refunds. The purchase transaction is governed by the Freemius Terms of Sale:
